Terms of Service

Last updated: October 16, 2026. Provider: Muntasir Alabdali, trading as BookedCall AI, Christian-Kruse-Str. 1, 24118 Kiel, Germany ("we").

1. Scope; businesses only

These terms apply to all services we provide. We contract only with businesses acting in their commercial capacity, not with consumers. By ordering, you confirm you are a business. Your own terms do not apply unless we accept them in writing.

2. Service

We set up and operate an AI voice assistant that answers calls you forward to it, collects caller information, can book appointments into a connected calendar, and sends alerts and summaries. The scope is defined in your order or written confirmation. Features listed as "not yet available" are not part of the contract. The service relies on third-party providers (e.g. voice AI, telephony, calendar, messaging); we do not guarantee uninterrupted or error-free availability. We may change providers if service quality is maintained.

3. No guarantee of results

The assistant is software and can misunderstand callers, mis-transcribe information or fail to connect. We do not guarantee any number of calls answered, bookings, jobs, revenue or other business results. You remain responsible for reviewing bookings and alerts and for your relationship with your customers.

4. Not an emergency service

The assistant is not an emergency service and does not replace 911 or a utility emergency line. Emergency alerts are a convenience notification and may be delayed or fail. You must configure your own emergency procedures, and the assistant is instructed to advise callers in danger (e.g. gas smell) to leave and call 911 or their gas utility.

5. Your responsibilities and compliance

You are responsible for: (a) the legality of using an AI assistant and recording/transcribing calls in your jurisdictions, including any required call-recording consent and AI disclosures (we provide a default disclosure greeting, which you must not remove where it is required); (b) the accuracy of the business information, hours, prices and services you give us; (c) obtaining any consents needed for contacting your callers; (d) your call forwarding and phone setup. You indemnify us against third-party claims arising from your breach of these obligations.

6. Trial, fees and payment

Prices are as on our pricing page or your order. Invoices are payable within 14 days by bank transfer. Prices are net; any taxes, duties or withholdings in your country are your responsibility. If payment is more than 14 days overdue, we may suspend the service after notice. A free trial ends automatically unless you confirm a paid plan in writing.

7. Term and cancellation

Monthly plans run month to month and may be cancelled by either party by email, effective at the end of the current paid month. We may terminate immediately for important cause, including non-payment or unlawful use.

8. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health, and where mandatory law (e.g. product liability) requires it. For slight negligence we are liable only for breach of an essential contractual obligation, limited to foreseeable damage typical for the contract, and in any case limited to the fees you paid in the 12 months before the event. Otherwise, liability for slight negligence is excluded, including for lost profits, lost jobs or lost data, and for failures of third-party providers or telecommunications networks outside our control.

9. Data protection

Where we process personal data of your callers on your behalf, we do so as your processor under a data processing agreement provided on request, and as described in our Privacy Policy.

10. Governing law and venue

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The exclusive place of jurisdiction is Kiel, Germany, to the extent legally permitted. If any provision is invalid, the remaining provisions stay in effect.
